CutScore — Terms of Service

These Terms of Service ("Terms") govern your use of CutScore (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Who we are
The Service is operated by 주식회사 더플레인웍스 (The Plain Works Co., Ltd.) ("we," "us"), based in Cheonan, Republic of Korea. Paid subscriptions are sold through Paddle, our Merchant of Record (§4).

2. The Service
CutScore is a study and exam-preparation tool for professional certification exams. It provides practice questions, explanations, adaptive study sessions, a personal notebook of missed concepts, and a readiness estimate intended to help you gauge your preparation.
The Service is a preparation aid. It is not affiliated with, endorsed by, or sponsored by any certification body (§9), and it does not administer exams or issue certifications.
3. Accounts and eligibility
You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account. You must be at least 16 years old to use the Service, consistent with the Privacy Policy.
You may not share, sell, or transfer your account, and you may not use the Service on behalf of another person without authorization.
4. Subscriptions, billing, and Merchant of Record
Paddle as Merchant of Record. Paid plans are sold and processed by Paddle, which acts as the Merchant of Record. This means Paddle is the seller of record for your purchase, handles payment processing and applicable taxes, and its buyer terms also apply to your transaction. We never receive or store your full payment details.
Plans and renewal. Paid subscriptions are billed on a recurring basis (monthly or annual, as selected) and renew automatically until cancelled. The price and billing interval are shown at the point of purchase.
Cancellation. You may cancel at any time; cancellation stops future renewals and your paid access continues until the end of the current billing period. We do not provide prorated refunds for partial periods except as stated in §5 or as required by law.
Price changes. We may change subscription prices; changes apply to billing periods beginning after we notify you.
5. Refunds
Except where required by applicable consumer-protection law or as expressly provided in the Pass Guarantee (§6), subscription fees are non-refundable once a billing period has begun. Full refund terms — including the 7-day first-purchase window and how to request a refund — are set out in the Refund Policy. Refund requests are handled in accordance with Paddle's buyer terms as Merchant of Record.
6. The Pass Guarantee
If you meet all of the eligibility conditions below and still do not pass your exam, you are entitled to the remedy described in this section. The claim mechanics are detailed in the Refund Policy.
Eligibility. To qualify for the Pass Guarantee, you must:
- Have held an active paid subscription continuously throughout your preparation;
- Have completed the preparation criteria defined in the Service (including reaching the Service's "ready — book your exam" state for your target exam, as indicated by your readiness estimate);
- Have sat the official exam for the certification you prepared for, in the exam version the Service covered at the time;
- Have submitted a verified failing score report (including valid proof) within 30 days of your exam date; and
- Not be excluded under the conditions below.
Remedy. If you qualify, your remedy is a full refund of your current subscription term.
Proof and verification. A qualifying claim requires a verifiable official score report. We may reasonably verify the authenticity of submitted proof and may decline claims based on fraudulent or unverifiable submissions.
Exclusions. The Pass Guarantee does not apply if: you did not reach the Service's "ready" state before sitting the exam; you sat a different exam version than the one the Service covered; you violated these Terms; or the claim is fraudulent or outside the claim window.
Relationship to readiness estimate. The Pass Guarantee is the sole, bounded exception to the general no-guarantee-of-passage disclaimer in §7. The readiness estimate is a probabilistic indicator, not a promise of passing (§7).
7. No guarantee of exam passage; content accuracy
No guarantee of passage. The Service is a preparation aid. Except for the bounded Pass Guarantee in §6, we do not guarantee that you will pass any exam. Exam outcomes depend on many factors outside our control, including your own preparation, the specific exam administered, and the certification body's scoring.
Readiness estimate is probabilistic. The readiness estimate is a statistical indicator of preparation, not a prediction or promise. It is presented with a confidence range and may be conservative, especially with limited data. You should not treat it as a guarantee.
Content may contain errors. Our practice questions and explanations are independently authored from public exam blueprints and documentation and are carefully reviewed, but they may contain errors. If you believe a question is incorrect, please report it; we maintain a correction process and will address valid reports. The Service's content does not constitute professional or technical advice.
8. Intellectual property
Our content. The practice questions, explanations, and other materials in the Service are our original work and intellectual property. You receive a limited, personal, non-transferable license to use them for your own exam preparation. You may not copy, redistribute, scrape, resell, or create derivative collections of our question bank or other content.
Your feedback. If you submit feedback or error reports, you grant us the right to use them to improve the Service.
9. Trademark disclaimer
CutScore is not affiliated with, endorsed by, or sponsored by Amazon Web Services, Inc. or any other certification body. All certification names, exam codes, and related trademarks (including, without limitation, "AWS" and "AWS Certified AI Practitioner") are the property of their respective owners. We reference them solely to describe the exams our Service helps you prepare for (nominative use).
10. Acceptable use
You agree not to: misuse or attempt to disrupt the Service; access it through automated means except as permitted; scrape or bulk-extract content; reverse-engineer the Service; submit or solicit real exam content; share paid content with non-subscribers; or use the Service for any unlawful purpose. We may suspend or terminate accounts that violate these Terms.
11. User-submitted content
When you submit a score report or other content (§6, and per the Privacy Policy), you confirm it is accurate and that you have the right to submit it. We handle score reports as described in the Privacy Policy §4.
12. Disclaimers and limitation of liability
The Service is provided "as is" and "as available," without warranties of any kind except as required by law. To the maximum extent permitted by applicable law, our total liability arising out of or relating to the Service is limited to the amount you paid us (or Paddle on our behalf) in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot be excluded by law.
13. Governing law and disputes
These Terms are governed by the laws of the Republic of Korea, without regard to conflict-of-laws principles, except where mandatory consumer-protection laws of your country of residence apply.
14. Changes to these Terms
We may update these Terms from time to time. We will revise the "Effective" date above and, for material changes, notify you through the Service or by email. Continued use after a change constitutes acceptance.
